Booking Terms and Conditions.

1. How to Book 

We are happy to accept your booking online at www.embarkwalkingholidays.com, or telephone our offices on + 44 (0) 7399 330178.  We will send out a secure link to your email address or mobile phone for Deposit and Balance payments.  UK payments can be made by Bank transfer or through our secure payment partner ‘go get paid’. International payments to be made by BIC/SWIFT payment.  Upon receipt of your Deposit of £200 per person your Holiday reservations will be made. The deposit is non-refundable. Should you request upgraded accommodation and non-refundable deposits are required by those accommodations, you will be asked to pay for these at the time of securing those rooms. 

Your Holiday balance will be due 8 weeks (56 days) prior to the start date of your walking holiday. If you book your holiday within 8 weeks (56 days) of the ‘start date’, your full balance will be payable at that time.

If payment is not received as above, we reserve the right to treat your booking as cancelled and your deposit/s would be forfeited.

Your holiday pack will be sent to you approximately 4 weeks before the start of your holiday.  Allow for extra delivery time on Overseas packs.

Please note, all correspondence for this booking will be made through the Lead Name only.  Should you wish to keep your party up to date it is your responsibility to forward correspondence. 

1a. Alterations by You

We shall book your holiday in accordance with your requested dates. If you need to change any details of your booking, we will do our best to help. If a change you have requested is made, we will charge an ‘Amendment Fee’. 

The fee will be £50 per person for each change to cover the additional communication time and costs involved, for those wishing to change/amend their booking more than 56 days prior to departure. Alterations after this date will be treated as a cancellation and re-booking, and the charges in Paragraph 2 will apply. An additional charge may be levied if we are unable to recover costs already incurred (for example, accommodation deposits).

Any alterations must be made by the Lead Name on the Booking Form.

1b. Alterations by Embark Walking Holidays.

On rare occasions, we may have to make a change to your booking. for example, to a different accommodation, or luggage transfer service. This is normally when something has occurred which is out of our control. We must therefore reserve the right to change the itinerary / accommodation where circumstances dictate. We shall advise the Lead Name of these amendments before your start date.

 

 2. If you need to Cancel your holiday.

Should you need to cancel your holiday, then you must advise us as soon as possible. Your cancellation will need to be confirmed in writing, and should be made by the Lead name on the booking form.

Our ‘Cancellation Fees’ will apply as follows; -

56 days or more before your start date = loss of deposit only

29 to 55 days before your start date = you will be charged 50% of holiday cost.

8 to 28 days before your start date = you will be charged 90% of holiday cost.

Less than 8 days, or whilst the holiday is in progress = you will be charged 100% of holiday cost.

In addition to these charges, extra charges may need to be added if a member(s) of a group booking cancels. 

We are obliged to implement these cancellation fees without exception. We therefore strongly advise you to take out adequate Travel Insurance to cover you against cancellation. 

 

3. Your Responsibilities

It is your responsibility to ensure you have a reasonable level of health / fitness, adequate experience, suitable clothes/equipment and remain aware of risks involved in a walking holiday. Although Embark Walking Holidays can assure you that with sensible precaution your holiday is as safe as possible you must accept the sole responsibility for your personal safety remains with you. In the interest of safety, you must undertake to follow the advice in the guide book or route notes as well as that provided by anybody on our behalf, heed any warning or advisory notices you may encounter on your walk, follow the Country Code and act sensibly and prudently at all times.

You are responsible to ensure that you and the rest of your party are in good health before and during your walking holiday. 

You are expected to conduct yourself in an orderly and acceptable manner. If in our opinion or in the opinion of any accommodation owner or manager or any other person in authority, your behaviour or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any other customers or any third party, or damage to property, we reserve the right to terminate your booking with us immediately. In the event of such termination, our liability to you will cease and you will be required to leave your accommodation or other arrangements immediately. We will have no further obligations to you or members of your party.   No refunds for lost accommodation or any other arrangements will be made and we will not pay any expenses or costs incurred as a result of termination. You may also be required to pay for loss and/or damage caused by your actions and we will hold you and each member of your party jointly and individually liable for any damage or losses caused by you or any member of your party. Full payment for any such damage or losses must be paid directly to the accommodation owner or manager or other supplier prior to departure. If you fail to make payment, you will be responsible for meeting any claims (including legal costs) subsequently made against us as a result of your actions together with all costs we incur in pursuing any claim against you. 

You are responsible for your own travel arrangements to the start point and from the finish point of you holiday.

If you choose to take any additional transportation, during your holiday, outside the arrangements made by Embark Walking Holidays, it is your responsibility to settle payment

Please read through our booking conditions carefully. The Lead Name person making the booking accepts the terms of these booking conditions on behalf of everyone named on the booking form.

4. Insurance

It is a condition of booking that all Participants have their own adequate travel insurance and that each is covered in the event of cancellation, personal accident, illness or loss of possessions. Embark Walking Holidays or its servants and agents cannot accept any responsibility for loss or damage to Participants’ luggage or for any illness or injury Participants might suffer whilst on holiday 

5. Embark Walking Holidays

We believe the details on the web site to be correct at the time of publication.  All arrangements made on behalf of clients are made in good faith. We reserve the right to modify the information, prices and itineraries on the website or take the website down altogether.  Any alterations will be advised at the time of booking.

Embark Walking Holidays acts as an intermediary for the services used during your holiday from hosts, taxi companies, luggage transporters or any other goods and services connected with your walking holiday. These suppliers are independent from Embark Walking Holidays and as such will have their own terms and conditions and privacy notices. 

6. Internet Postings

Embark Walking Holidays would like you to spread the word about the wonderful holiday and service you have received whilst on one of our walking holidays. At the same time, we expect participants to respect our organisation, and not to disparage Embark Walking Holidays in postings on the Internet (websites, Facebook, YouTube, Twitter or other sites). Please note that Embark Walking Holidays website and information contain copyrighted materials, trademarks, protected trade names and logo that are the sole property of Embark Walking Holidays.  Please do not copy, broadcast, publicise or disseminate (unless for personal use) with out our written permission. 

7. Force majeure 

We regret we cannot accept any liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by, or you otherwise suffer any damage or loss as a result of force majeure.  Force majeure means any event which we, or the supplier of the service(s) in question, could not, even with all due care, foresee or avoid.  Such events include but are not confined to, pandemics, war or threat of war, riots, civil strife, terrorist activities, industrial disputes, fire, natural or nuclear disasters, adverse weather conditions and all similar events outside our control.

8. Luggage transfers

It is your responsibility to ensure your bags for luggage transfers are packed safely. Please do not pack fragile or valuable items, such as phones, cameras, computers. Also, do not pack glass bottles which can easily break and damage not only yours but other walkers’ bags and contents.  Bags should weigh no more than 20kg. Baggage handling operatives may refuse to handle heavier bags, or indeed make additional charges.  Please take note of the luggage transfer information contained in your walking booklet.

Embark Walking Holidays does not accept any liability for loss or damage to items of luggage or its contents during said transfers.

9. Acceptance of our Terms and Conditions.

Your booking is accepted on the basis of the above conditions which are governed by English law and the jurisdiction of the English and Welsh Courts. The above booking conditions constitutes the limit of our liabilities, please do not ask us to change them after booking.
